Prof. Dr. Mark D. Cole
Professor Dr. iur. Mark D. Cole (Jg. 1972) ist Professor für Medien- und Telekommunikationsrecht an der Universität Luxemburg (seit 2007) und Wissenschaftlicher Direktor des Instituts für Europäisches Medienrecht (EMR) in Saarbrücken (seit 2014).
An der Universität Luxemburg ist er ferner u.a. Studiendirektor für den „Master in Space, Communication and Media Law (LL.M.)“ und Fakultätsmitglied im „Interdisciplinary Centre Security, Reliability and Trust (SnT)“. Er ist Mitglied der beratenden Versammlung der Medienaufsichtsbehörde ALIA (Autorité luxembourgeoise indépendante de l'audiovisuel), Co-Direktor des Instituts für Rechtsinformatik an der Universität des Saarlandes und im Advisory Council der European Audiovisual Observatory des Europarates vertreten. Er war für die Periode 2020-21 vom Europarat in das Committee of Experts on Media Environment and Reform (MSI-REF) berufen worden.
Sein Schwerpunkt ist europäisches und vergleichendes Medienrecht in der gesamten Bandbreite vom Rechtsrahmen für traditionelle Medien über Regulierungsfragen für das Internet bis hin zu Datenschutz- und Urheberrecht (http://www.medialaw.lu). Er hat Rechts- und zeitweise Politikwissenschaften an der Johannes Gutenberg-Universität Mainz studiert, Erstes Staatsexamen 1998, Zweites Staatsexamen 2004 jeweils mit Schwerpunkt Europarecht und mit Stationen im Referendariat bei der Kommission (GD Wettbewerb), einer öffentlich-rechtlichen Rundfunkanstalt und einer Urheber- und Medienrechtskanzlei. Promotion an der Universität Mainz 2003. Vor dem Wechsel an die Universität Luxemburg 2007 war er an der Universität Mainz am Lehrstuhl für Öffentliches Recht, Völker- und Europarecht, Medienrecht, dem Mainzer Medieninstitut sowie der TU Braunschweig tätig; aktuell ist er weiterhin in Mainz Lehrbeauftragter für Europäisches Medienrecht.
Mitherausgeber/-autor der Werke „Heidelberger Kommentar zum Rundfunkstaatsvertrag/ Jugendmedienschutzstaatsvertrag“, „Europäisches und Internationales Medienrecht“, „Handbuch Medienrecht – Recht der elektronischen Massenmedien“ und der in Vorbereitung befindlichen Kommentare zur „AVMSD“ und der „DSGVO“ sowie Verfasser zahlreicher Beiträge zum Medienrecht in deutsch, englisch und französisch; Gründungs- und Mitherausgeber der Zeitschriften European Data Protection Law Review (EdpL) und der neuen UFITA – Archiv für Medienrecht und Medienwissenschaft, ferner Mitherausgeber von Revue du Droit des Technologies de l'Information (R.D.T.I.), International Journal of Law and Information Technology (IJLIT), Schriftenreihe des Instituts für Europäisches Medienrecht (EMR) und der Reihe EMR/Script.
Prof. Cole publiziert und gibt Vorträge an internationalen Konferenzen in zahlreichen Europäischen Staaten und den USA zu Themen des Medien-, Informations- und Kommunikations-, Datenschutzrecht ebenso wie Völker- und Europarecht. Er berät regelmäßig als Experte öffentliche Einrichtungen auf EU und nationaler Ebene.

Mark D. Cole is Professor for Media and Telecommunication Law at the University of
Luxembourg since 2007 and Director for Academic Affairs at the Institute of
European Media Law (EMR) in Saarbrücken since 2014.
At the University of Luxembourg he is also Faculty Member of the Interdisciplinary
Centre for Security, Reliability and Trust (SnT) and Study Programme Director for the
Master in Space, Communication and Media Law (LL.M.) at the Department of Law.
He is member of the Advisory Committee of the Luxembourg Independent Media
Authority (Autorité luxembourgeoise indépendante de l'audiovisuel, ALIA), Co-Director
of the Institute of Legal Informatics (Institut für Rechtsinformatik) at the Universität des
Saarlandes and takes seat in the Advisory Council of the European Audiovisual
Observatory of the Council of Europe. He was appointed to the Council’s Committee
of Experts on Media Environment and Reform (MSI-REF) for the period of 2020-21.
He specialises in European and Comparative Media Law, covering the whole range of
the regulatory framework for both traditional mass media as well as the law of the new
information technologies which includes data protection, intellectual property law and
cyberlaw; he has a research focus on the EU AVMSD / DSM regulatory framework
(www.medialaw.lu). He studied law and political science and holds a doctorate from
the Johannes Gutenberg Universität Mainz (2003) as well as both German State
Examinations in Law (1998/2004). He gained practical experience in media law at the
DG Competition of the European Commission, a law office specialising in Intellectual
Property Law and the legal department of a television broadcaster. Before joining the
University of Luxembourg he had positions at the Chair in Public Law, Public
International and European Law, Media Law in Mainz, the Mainz Media Institute, the
TU Braunschweig; he continues to teach in an LL.M. programme in Media Law in
Mainz.
Mark D. Cole is co-editor of the publications “Medienstaatsvertrag /
Jugendmedienschutzstaatsvertrag – Heidelberger Kommentar”, “Europäisches und
Internationales Medienrecht” as well as the forthcoming commentaries “The EU
Audiovisual Media Services Directive – Comparative Commentary on the AVMSD and
National Implementation” and the “General Data Protection Regulation (GDPR)”; he
is co-founder and associate editor of European Data Protection Law Review (EdpL)
and UFITA (Archiv für Medienrecht und Medienwissenschaft), co-editor of Revue du
Droit des Technologies de l'Information (R.D.T.I.) and International Journal of Law and
Information Technology (IJLIT) as well as a number of book series.
Prof. Cole has published and guest lectured in many European countries and the U.S.
and is a regular speaker at international conferences, on subjects of Media, ICT and
Data Protection Law as well as Public International Law and European Law and
regularly contributes as expert to the work of public institutions on EU and national
level.
